ENTER RAFFLE FOR A CHANCE TO WIN GIFTZ

i. ELIGIBILITY:

The “Enter For A Chance To Win Giftz” promotion (hereinafter referred to as “PROMOTION” or “GIFTZ”) is exclusively open to all legal residents of the fifty (50) United States and District of Columbia who are 18 years of age or older as of the date of the entry. Employees of Onlygiftz, LLC, their affiliate companies, suppliers, immediate family members (spouse, parents, siblings, and children), Partners at Cocotech, Ltd. and household members of each such employee are ineligible. This Promotion is governed by all applicable federal, state, and local laws and regulations and is void where prohibited.

Participation signifies the raffle participant’s full and unconditional agreement to these Official Rules and Regulations and the decisions of the Distributor as well as the Administrator, which are final and binding in all matters related to the Promotion. Winning a raffle/prize is contingent upon fulfilling all requirements set forth herein. The Promotion consists of a sweepstakes (the “Sweepstakes”).

iv. TIMING:

The Promotion commences on the date and time displayed on the event’s details page. The administrator’s computer is the official time-keeping device for this Promotion.

v. HOW TO ENTER:

During the Promotion Period, visit the event link, complete the required legal information, and submit the registration form. Any falsified information or submissions utilizing automated systems (“BOTS”) to bypass Onlygiftz platform’s system will result in automatic disqualification and potential legal action. Each participant will receive one (1) entry into the Sweepstakes every twenty-four (24) hours from their original submission. All potential winners are subject to verification before any prize is awarded. Complimentary entries may be earned as referral compensation through (“BONUS”) submissions via referral or future raffle purchase options.

vi. LIMIT:

Each participant may enter the Sweepstakes one (1) time during the Promotional Period. Multiple raffle participants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of plays/entries by using multiple/different email addresses, identities, registrations, and logins, or any other methods will void that raffle participant’s entries/submissions and that the raffle participant may be disqualified. Use of any automated system to participate is prohibited and will result in automatic disqualification. The distributor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the participant or the player. The “authorized account holder” is the natural individual assigned an email address by an internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. The proper government identification card must match the name of the winning submission entry. Any potential winners may be required to show proof of being the authorized account holder.

vii. VERIFICATION OF POTENTIAL WINNERS:

All potential winners are subject to rigorous verification by the Distributor or Administrator, whose decisions are final and binding in all matters related to the promotion or raffle. A raffle participant is not considered a winner of any prize or Giftz, even if the sweepstakes indicates otherwise, until the raffle participant’s eligibility has been verified and the participant has been notified that the verification is complete with an approval. The distributor will not accept screenshots or other evidence of winning in lieu of its validation process. Any raffle that occurs after a system failure or a system glitch for any reason is deemed defective, void and will not be honored.

viii. RECEIVING PRIZES OR WINNING GIFTZ:

Receiving a prize or winning Giftz is contingent upon compliance with these Official Rules and Regulations. The potential Sweepstakes winner will be notified via the platform’s messenger, email, mobile app, or phone SMS/Text. The potential Grand Prize winner will be required to complete a signed Declaration of Compliance, Liability, and Public Release. If the potential winner cannot be contacted, fails to sign the required documents, or if the prize is returned as undeliverable, the potential winner forfeits the prize or Giftz. If a potential winner is disqualified for any reason, the Distributor will award the applicable prize to an alternate winner by random drawing. Unclaimed Third Prizes will not be awarded.

ix. PRIZES:

Receiving a prize or winning Giftz is contingent upon compliance with these Official Rules and Regulations. The potential Sweepstakes winner will be notified via the platform’s messenger, email, mobile app, or phone SMS/Text. The potential Grand Prize winner will be required to complete a signed a Declaration of Compliance, Liability, and Public Release, which must be received by the Administrator within the potential winner of any prize or Giftz can’t be contacted, signature failure and completion and submission of the Declaration of Compliance, Liability, and Publicity Release within the required time period (if necessary), or if the prize is returned as undeliverable, the potential winner forfeits the prize or Giftz. If a potential winner of the Grand Prize, First Prize, or Second Prize is disqualified for any reason, the Distributor will then award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries or submissions. There will be three (3) alternate drawings, after which the prize will remain unawarded. Unclaimed Third Prizes will not be awarded or will no longer be required for an additional drawing.

x. RELEASE:

By receipt of any prize or Giftz, the winner agrees to release and hold the Distributor harmless, along with their respective affiliates, suppliers, distributors, advertising/promotion, agencies, and each of their respective parent companies, officers, directors, employees, and agents from any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of the participation in the Promotion or receipt or use or misuse of any prize.

xi. PUBLICITY:

Except where prohibited, participation in the Promotion constitutes the winner’s consent to the Distributor’s and its agents use of the winner’s name, likeness, photograph, voice, opinions, hometown and state, and social media handles for promotional purposes in any media, globally, without further payment, compensation or consideration.

xii. GENERAL CONDITIONS:

The Distributor reserves the right to cancel, suspend, and/or modify the promotion, or any part of it, if any fraud, technical failures, incorrect information, or any other factor beyond the Distributor’s reasonable control impairs the integrity of proper functioning of the Sweepstakes, as determined by the Distributor in its sole discretion. In such an event, the Distributor reserves the right to award the prizes at random from among the eligible entries or submissions received up to the time of the impairment. The Distributor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules and Regulations of this or any other promotions or in an unsportsmanlike or disruptive manner. Any attempt by such individual to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal act and civil law, and should such an attempt to be made, the Distributor reserves the right to seek damages from any such person to the fullest extent permitted by the law. The Distributor’s failure to enforce any term of these Official Rules and Regulations shall not constitute a waiver of that provision.

xiii. LIMITATIONS OF LIABILITY:

The Released and Distributing Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by raffle participants, website managers, printing errors, or by any of the equipment or programming associated with or utilized in the Promotions. (2) Technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) Unauthorized human intervention in any part of the entry process or the promotion; (4) Technical or human error which may occur in the administration of the promotion or the processing of entries; or (5) Any injury or damage to individuals or property which may be caused, directly or indirectly, in whole or in part, from a raffle participant’s participation in the Promotion or receipt or use or misuse of any prize or Giftz. If for any reason, a raffle participant’s entry or play is confirmed to have erroneously deleted, lost, or otherwise destroyed or corrupted, the raffle participant’s sole remedy is another Sweepstakes entry, if possible. If the Promotion, or any part of it, is drawing from among all eligible entries received up to date of discontinuance for any or all the prizes or Giftz offered herein. No more than the stated number of prizes or Giftz will be awarded. In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as set forth in these Official Rules and Regulations to be available and/or claimed, the Distributor reserves the right to award only the stated number of prizes or Giftz by a random drawing among all legitimate, unawarded, eligible prize or Giftz claims.

xiv. DISPUTES:

Except where prohibited, the raffle participant agrees that: (1) Any and all disputes, claims, and causes of action, arising out of or the connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the appropriate Nevada State Court located in Clark County, Nevada; (2) Any and all claims, judgements, and awards shall be limited to actual out -of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorney’s fees; and (3) Under no circumstances will the raffle participant be permitted to obtain awards for, and the raffle participant hereby waves all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for the actual out of pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, structure, interpretation, and enforceability of these Official Rules and Regulations, or the rights, and obligations of the entrant and the Distributor in connection with the Promotion, shall be governed by and construed in accordance with, the laws of the State of Nevada, without giving effect to any choice of law or conflict of law rules (whether of the State of Nevada or any other jurisdiction), which could cause the application of the laws of any jurisdiction other than the State of Nevada.

xv. TAXES:

All costs, taxes, fees, and expenses associated with a prize or Giftz or the acceptance and the use of any element of a prize not specifically address above are the sole responsibility of the winner. All federal, state and local taxes on the prize are the winner’s responsibility. Winners must submit a W9 to receive the prize or Giftz. Prize winners will be issued a 1099 form for the actual retail value of the prize or Giftz if the actual value is greater than three hundred US dollars ($300.00).

xvi. NON-TRANSFER AND NON-RESELL:

All winning prizes or Giftz must not be re-transferred or re-sold to another party. Any case that a winning participant does such transfer or re-sell, the participant will automatically receive a 5-year ban on the Onlygiftz.com platform and any of its partners & affiliations. A participant who breaches this clause will be held accountable legally.

xvii. RAFFLE PARTICIPANT’S PERSONAL INFORMATION:

Information collected from raffle participants is subject to Distributor’s Privacy Policy at privacy policy.

xviii. WINNER LIST:

For the winners’ list, email giftz@onlygiftz.com requesting strictly for the winner’s list for Onlygiftz platform’s promotions. Allow a minimum of 2-5 business days for proper correspondence.
